Terms of Service
||NAM — getnam.app Version 1.0 Effective: 1 September 2026 Last updated: 1 September 2026
This is the first version of the ||NAM Terms of Service. It applies from its effective date onwards. When you create an account, we record which version of these Terms you accepted.
1. Who we are and what these Terms govern
||NAM ("the app", "the service") is operated by Ottmic Productions CC, a close corporation registered in Namibia ("we", "us", "our").
These Terms of Service ("Terms") govern your access to and use of the ||NAM mobile application and any related services. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use ||NAM.

2. Eligibility — minimum age 18
||NAM is strictly for adults. You must be at least 18 years old to create an account or use the service. By registering, you represent and warrant that you are 18 or older.
If we discover or reasonably suspect that a user is under 18, we will immediately suspend and permanently delete their account without notice. We may require age verification at any point.
3. What ||NAM is — and is not
||NAM is a platonic human connection app. Its purpose is to help people find and share genuine, non-romantic, non-sexual physical and emotional connection — specifically, hugs and in-person human warmth.
||NAM is explicitly not a dating app.
The following are prohibited on ||NAM at all times:
- Romantic or sexual advances, messaging, or solicitation of any kind
- Sexual content of any kind, including images, video, text, or links
- Any communication that is intended to initiate a romantic or sexual relationship
- Using ||NAM to find dates, partners, or sexual encounters
Violations of this rule will result in immediate account suspension or permanent removal.
4. User conduct
You agree to use ||NAM only for lawful purposes and in a manner consistent with these Terms and our Community Guidelines. You must not:
- Harass, intimidate, abuse, threaten, or bully any other user
- Impersonate any person or entity, or create a false or misleading profile
- Create multiple accounts
- Upload photos or content you do not have the right to use, or that depicts another person without their consent
- Share, publish, or distribute another user's personal information without their consent (doxxing)
- Use ||NAM for commercial solicitation, advertising, or any business purpose
- Attempt to move conversations off-platform as a condition of interaction
- Share personal contact details — phone numbers, email addresses, physical addresses, or handles or links for other messaging or social platforms — in ||NAM messages in a conversation in which no meetup request has yet been accepted
- Request money, gifts, or financial assistance from other users
- Engage in scams, deception, or coercion of any kind
- Use ||NAM to stalk, monitor, or track another user
- Misuse another user's location data, trusted-buddy information, or meetup details
- Post hate speech, discriminatory content, or content that incites violence
- Share screenshots or private messages without the other user's permission, except when submitting a safety report
- Attempt to circumvent a block, suspension, or account removal
- Use the app in any way that could damage, disable, overburden, or impair it
- Attempt to access any part of the service or another user's account without authorisation
5. Intellectual property and user content
Your content
You retain ownership of content you upload to ||NAM (photos, text, profile information). By uploading content, you grant Ottmic Productions CC a non-exclusive, worldwide, royalty-free licence to store, display, and transmit your content for the purpose of operating and providing the service.
You represent and warrant that:
- You own or have the necessary rights to upload all content you post
- Your content does not infringe any third-party intellectual property rights
- You have the consent of any identifiable person depicted in photos you upload
Our intellectual property
All rights in the ||NAM brand, app design, software, and content produced by us belong to Ottmic Productions CC. You may not reproduce, copy, or distribute any part of ||NAM without our written permission.
6. Identity verification
Identity verification is available to eligible ||NAM Plus and ||NAM Premium members, and is included in those plans at no additional verification charge. Verification is carried out by our third-party provider Didit.
Successful identity verification within your current membership cycle unlocks Verified Hugger status and the verified meetup capabilities — sending and accepting meetup requests. Buying a plan does not by itself verify your identity; you must complete verification successfully. Verified Hugger is a status and badge, not a separate subscription plan.
Free users and users on the 30-Day Launch Pass do not receive Verified Hugger status and cannot send or accept meetup requests. Free users may use core matching and messaging functionality subject to Free-plan limits.
You acknowledge and agree that:
- Verified Hugger status confirms that a user completed a verification process at a point in time. It is not a background check.
- Verified Hugger status is not an endorsement of a user's character, intentions, conduct, or safety.
- Verified Hugger status does not guarantee that a user is who they claim to be at any subsequent time.
- Verification does not replace your own judgment and safety precautions.
- Ottmic Productions CC is not responsible for the accuracy of verification outcomes, which are determined by Didit.
7. In-person meetups — safety and liability
||NAM may facilitate the coordination of in-person meetups between users. You acknowledge and agree that:
- You decide entirely on your own whether to meet another user in person. There is no obligation to do so.
- You must exercise your own judgment before and during any in-person meeting. We provide safety guidance in-app, and we encourage you to read and follow it.
- ||NAM cannot verify the conduct, intentions, identity, or safety of any user during an in-person meeting.
- ||NAM is not an emergency service. It is not a medical, counselling, or crisis-response service. If you are in immediate danger, contact your local emergency services.
- Our liability for in-person interactions between users is limited to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence.
8. Subscriptions, billing, and purchases
Platform billing
All subscription purchases and in-app purchases are processed entirely by Apple (App Store) or Google (Google Play), depending on your device. Ottmic Productions CC does not process your payment card details directly.
Subscription terms
- Subscriptions renew automatically unless you cancel before the renewal date.
- Cancellation and refund policies are governed entirely by Apple's or Google's terms, as applicable. We encourage you to review those terms before purchasing.
- We do not issue refunds directly. Refund requests must be submitted to Apple or Google.
Price changes
Subscription prices may change from time to time. Any price change affecting an existing subscription will be handled through the applicable app-store platform and will take effect only in accordance with Apple's or Google's applicable notice, consent, and renewal requirements. Where the platform requires your consent to a price increase and you do not consent, your subscription may expire at the end of the then-current billing period.
Subscription management
You can manage and cancel your subscription in your device's subscription settings (App Store or Google Play). Deleting the app does not cancel your subscription.
9. Account suspension and termination
Termination by you
You may delete your account at any time from within the app, or by contacting us at privacy@getnam.app. See our Account Deletion page for details.
Termination or suspension by us
We may suspend or permanently delete your account if you violate these Terms or our Community Guidelines. For serious safety violations — including but not limited to sexual solicitation, threats of violence, child safety violations, or harassment — we may act immediately and without prior notice. For less severe matters, we will generally attempt to notify you.
We aim for proportionate enforcement. If your account is suspended or content is removed, you may contact legal@getnam.app to enquire about the decision. We are not obligated to reverse any moderation decision.
Effect of termination
On deletion or termination of your account, your live profile, authentication identity, profile photos, and ordinary access to messages, connections, meetups, and other account activity are removed from the active service, subject to the limited retention described in our Privacy Policy. This can include a restricted safety archive, limited transaction/subscription records retained for financial, tax, accounting, fraud, dispute/chargeback, entitlement or legal-compliance purposes, and temporary residual copies in provider backups until normal retention/rotation removes them. Records held independently by Apple, Google, RevenueCat, Didit or other processors may be subject to those providers' own retention obligations and policies.
10. Moderation and content removal
We reserve the right to remove any content that violates these Terms or our Community Guidelines, without notice. We do not guarantee that all violating content will be identified and removed promptly.
Automated screening of messages
Message content is automatically checked before delivery for prohibited sharing of personal contact information. The check operates per conversation. Once a meetup request has been accepted in a conversation, contact sharing becomes available in that conversation and remains available there, and messages in that conversation are no longer checked for contact information. Other conversations are unaffected. If a message is blocked, we record the violation and tell you that the message was not sent. Repeated blocked attempts within a short period can trigger a temporary restriction on sending messages, which lifts by itself when it expires. Serious or persistent misuse may also lead to suspension or removal under section 9.
These checks are automated and are not perfect: a legitimate message may occasionally be blocked, and not every prohibited message will be caught. If you believe a message was blocked or your messaging was restricted in error, contact support@getnam.app and a person will review it. How this screening is carried out is described at a high level in our Privacy Policy; we do not publish its detail, because that would help people evade it.
11. Disclaimer of warranties
To the fullest extent permitted by Namibian law and applicable law in your jurisdiction:
- ||NAM is provided "as is" and "as available" without warranties of any kind, express or implied.
- We do not warrant that the app will be uninterrupted, error-free, or free of viruses or harmful components.
- We do not warrant the accuracy, completeness, or reliability of any content posted by users.
Nothing in this section affects any non-waivable statutory rights you may have under the law of your country.
12. Limitation of liability
To the fullest extent permitted by applicable law, Ottmic Productions CC's total aggregate liability to you arising out of or in connection with these Terms or your use of ||NAM will not exceed the lesser of (a) the total amount you actually paid to ||NAM during the 12 months immediately preceding the event giving rise to the claim, and (b) US$100.
We are not liable for:
- Loss of data
- Loss of revenue or profits
- Any indirect, consequential, or special losses
- Any harm arising from in-person interactions between users
Nothing in these Terms excludes or limits liability for:
- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot lawfully be excluded under applicable law, including mandatory consumer protections that apply in your country
13. Future EU/EEA availability and the Digital Services Act
||NAM is not currently intentionally offering or marketing the service in the EU/EEA. Before intentionally launching or marketing ||NAM there, we will reassess the obligations that may apply under the EU Digital Services Act, including whether a legal representative under DSA Article 13 is required.
A DSA Article 13 representative is legally distinct from a GDPR Article 27 representative. Any future appointment decision will therefore be assessed separately.
Regardless of market, users may report allegedly illegal or policy-violating content using the in-app Report & Block feature or any dedicated reporting route we make available.
14. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Namibia.
This governing-law clause does not deprive you of any mandatory consumer rights or privacy protections that apply under the law of your country of residence and that cannot be waived by contract. South African users retain all rights under POPIA and applicable South African consumer law. If mandatory consumer or privacy law in another jurisdiction applies to you, those non-waivable protections continue to apply.
Any dispute that cannot be resolved informally will be subject to the jurisdiction of the competent courts of Namibia, without depriving you of any mandatory right to bring proceedings in another jurisdiction where applicable law gives you that right.
15. Apple and Google platform terms
If you downloaded ||NAM from the Apple App Store, Apple's Standard End User License Agreement for Apps applies in addition to these Terms to the extent required by Apple. Apple is not a party to these Terms and has no responsibility for ||NAM.
If you downloaded ||NAM from Google Play, Google Play's terms also apply. Google is not a party to these Terms and has no responsibility for ||NAM.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice before the change takes effect. Continued use of ||NAM after a change takes effect constitutes acceptance of the updated Terms. If you do not accept the updated Terms, you should delete your account.
17. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
18. Entire agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Ottmic Productions CC regarding your use of ||NAM.
19. Account verification and transactional SMS
This section describes ||NAM SMS Verification, the one-time-passcode programme ||NAM uses to confirm that a mobile number belongs to you. ||NAM is passwordless. When you ask us to register an account, sign in, link or change your mobile number, or complete another supported account-verification action, we send a one-time verification code by SMS to the mobile number you entered. We may also send account-security SMS messages relating to your account.
How you start it. You enter or confirm your mobile number on the sign-up, sign-in or phone-verification screen and deliberately tap "Send Code" — or the equivalent sign-in action on that screen — to request the code. "Resend" makes the same request again.
This is not a marketing programme. Nothing in this section creates one, and requesting a verification code does not sign you up to receive promotional or marketing messages. We do not send marketing SMS.
Message frequency. Message frequency varies according to your own requests — we send a code when you ask for one, including when you use "Resend".
Rates. Standard message and data rates may apply. Your mobile operator's charges are between you and your operator.
STOP and HELP. On Telnyx-routed messages — which include United States (+1) mobile numbers and every other destination ||NAM delivers by Telnyx — you can reply STOP to opt out and HELP for help. Messages to Namibian (+264) and South African (+27) numbers are delivered through Africa's Talking from a sender ID or short code that does not receive replies, so replying STOP or HELP to those messages will not reach us. If you are on one of those routes and want to stop receiving verification codes, stop requesting them, or contact us at https://www.getnam.app/support.
What opting out means. Because ||NAM has no account password, the SMS code is how phone-based registration, sign-in and phone verification work. If you opt out, you may be unable to register, sign in, or verify your number by phone until you opt back in or another supported verification method becomes available to you.
Not a condition of purchase. Consent to receive authentication SMS is not a condition of purchasing any paid ||NAM plan.
Delivery. SMS delivery depends on mobile networks and carriers and is outside our control. Messages may be delayed or fail to arrive. Carriers are not liable for delayed or undelivered messages.

How we handle your mobile number and these messages, including that mobile information and SMS consent are not sold, rented or shared for third-party marketing, is set out in our Privacy Policy: https://www.getnam.app/privacy.
